For this right, with the conditions described below, we offer you a one-time payment of US${o2}. We agree to pay you this amount within 60 days of publication.

The Empire & Great Jones Creative Arts Foundation hereby requests the right to publish your work, titled “{title}”, in the collection Ember: A Journal of Luminous Things. For this right, with the conditions described below, we offer you a one-time payment of US${o2}. We agree to pay you this amount within 60 days of publication.

Rights Assigned

With this agreement, you grant us worldwide exclusive First Publication rights to publish “{title}” in multiple print and/or electronic formats for twelve months from acceptance or six months from publication, whichever is earlier; a three-year non-exclusive worldwide license from the date of publication to continue to publish your work in the same or other formats as part of the collection in which it is first published without extending the license term and without constituting a new publication, and to keep that discrete volume of our anthology available in our salable inventory throughout that term; and a perpetual non-exclusive worldwide license from the date of publication to continue to display it on our web site.

The purpose of the perpetuity clause is to recognize the nature of web sites and the longevity of content posted to them—not to control your work indefinitely. Therefore, you may revoke the perpetual license in writing at any time after twelve months following publication and we will make every effort to purge your work from all systems under our control.

You also agree to allow us to make this piece available, in whole or in part, in digital format online or in e-mail distribution as part of promoting your work and the volume of our anthology which contains it. In no case are we allowed to display or distribute your work in any form after the end of the license term without your explicit and written permission.

We intend to publish this work within six weeks of this acceptance. However, we may delay publication to a future period for any reason, including but not limited to “thematic fit” and “number of pieces scheduled for the intended period.” In the event that such delays exceed 12 months from the date of this agreement, all rights (including First Publication, if applicable) revert to you, the US${o2} payment must be remitted to you promptly, and we must renegotiate with you if we still wish to publish your work.

Publication Schedule

We intend to publish this work within 18 months, and we agree to notify you at least 30 days before releasing the collection which will contain it. We may delay publication to a future collection for any reason, including but not limited to “thematic fit” and “number of pieces selected for a volume.” In the event that such delays exceed 18 months from the date of this agreement, all rights (including First Publication, if applicable) revert to you, the US${o2} payment must be remitted to you promptly, and we must renegotiate with you if we still wish to publish your work.

Please indicate what audience you feel “{title}” is most appropriate for.

While all prose is now eligible for consideration, works that are especially appropriate for middle-grade (MG) or young-adult (YA) audiences—or which can be easily edited to be appropriate for a broad audience (even if they are not necessarily targeted at younger listeners)—are a great fit for this program.
